1. Who we are

Absolute RC Simulator (this site, the browser simulator and the model and landscape content in it) is published by Happy Bytes LLC, which also publishes the ClearView desktop simulator and the Absolute RC mobile apps. "We" and "us" below mean Happy Bytes LLC; "you" means the person using the service.

2. Your account

An account is identified by your email address. We sign you in with a one-time link sent to that address rather than a password, so keeping access to your mailbox is what keeps your account secure. One account is for one person; please do not share it.

You can ask us to close your account and delete your data at any time through the support page.

3. Plans, billing and cancellation

• The Free plan needs no payment and is limited — a daily allowance of flights and a subset of the aircraft and fields.
• Paid plans (Plus and Pro) are monthly subscriptions that renew automatically until cancelled. Prices are shown on the plan page and are in US dollars.
• Payments are taken through PayPal. We never see or store your card or bank details. On the PayPal page and on your statement the merchant appears as Absolute RC Simulator / Happy Bytes LLC.
• Cancel any time from My Account or from your PayPal account. Cancelling stops the next renewal; your plan keeps working until the end of the period you have already paid for.
• Where a free trial is offered, its length and terms are stated at sign-up. Unless we say otherwise, a trial converts to a paid subscription when it ends.
• If a payment fails, we may suspend paid features until it is settled.
• Refunds are covered by our Refund Policy.

We may change prices or what a plan includes. If a change affects a plan you are already paying for, we will tell you by email before it takes effect, and you are free to cancel.

4. What you may and may not do

Please do not:

• share, resell or sublicense access to the service, or use one account for several people;
• extract, redistribute or republish the aircraft, landscape, texture or sound content;
• attempt to bypass plan limits, the sign-in system or the content protection;
• disrupt the service or the experience of other users, or use it to break the law.

We may suspend or close an account that does these things.

5. Content and ownership

The simulator, its flight model, and the aircraft and landscape content remain the property of Happy Bytes LLC or its licensors. Your subscription is a personal, non-transferable licence to use them inside the service while your plan is active — it does not transfer ownership of anything.

6. Availability and "as is"

This is a simulator for entertainment and practice. It is provided as is, without warranty of any kind. We do not promise uninterrupted availability: hosting, browsers and hardware vary, and we take the service down for maintenance from time to time. Practising here is not a substitute for care and judgement when flying a real model aircraft, and we are not responsible for what happens at the flying field.

7. Limitation of liability

To the extent the law allows, our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim, and we are not liable for indirect or consequential loss.

8. Changes to these terms

We may update these terms; the "last updated" date above always reflects the current version. Material changes affecting paid plans are announced by email. Continuing to use the service after a change means you accept the updated terms.

9. Governing law

These terms are governed by the laws of the United States and of the state in which Happy Bytes LLC is registered, without regard to conflict-of-laws rules.
